REGULARLY SCHEDULED ZONING BOARD OF ADJUSTMENT MEETING

MAY 10, 2007

MINUTES

 

Members Present:        Chairman Jay Ring, Ron DeSimone, Catherine Young, Connie                                            Dennis, Phil Wight, Dean Tomlinson, and Garrett Anderson came                                       by to say he had to go into work. 

 

Staff Present:  Planning Director Nathan Clark and Deputy Clerk Shayne Wheeler

 

 

Meeting Called to Order

Chairman Ring called the meeting to order at 5:37 p.m. in the Town Hall Boardroom. Mr. Anderson asked to be excused because of an obligation at work. Mr. Anderson was excused.

 

 

Correction or Approval of Minutes: April 12, 2007

MS. DENNIS MADE A MOTION TO APPROVE THE MINUTES WITH THE CORRECTION OF SHOWING MS. YOUNG PRESENT AT THE MEETING.

MR. PINTER SECONDED THE MOTION.

MOTION CARRIED UNANIMOUSLY.

 

 

Variance Request: Smoky Mountain Creekside Villas

Deputy Clerk Wheeler administered the oath to Mr. Pinter.

 

Mr. Clark provided the following details.

  1. In April 2006, the Zoning Board of Adjustments allowed Mr. Pinter to have residential use in the commercial district.
  2. In May 2007, the Planning Board approved the Preliminary Plat.
  3. The Zoning Ordinance requires structures to be separated by at least 20-feet.
  4. The Town of Maggie Valley’s sewer easement along the perimeter of the property requires a 10-foot setback.  This places constraints on the required 20-foot building separation. Mr. Pinter would be able to place the buildings 17-feet apart with an approved variance.

 

After reviewing the map, showing the utility easement the following motion was made.

 

MR. WIGHT MADE A MOTION TO GRANT THE VARIANCE FOR SMOKY MOUNTAIN CREEKSIDE VILLAS.

MS. DENNIS SECONDED THE MOTION.

MOTION CARRIED UNANIMOUSLY.

 

THERE BEING NO FURTHER BUSINESS TO DISCUSS, ON MOTION OF MS. DENNIS, SECONDED BY MR. WIGHT, THE MEETING ADJOURNED AT 6:10 P.M.
