Continued Zoning Board of Adjustment Meeting

February 24, 2005

MINUTES

 

Members Present:       Chairman Jay Ring, Phil Wight, Larry Dubuke, and Torry Pinter

Members Absent:       James Hannan

Staff Present:              Planning Director Kevin Byrd and Town Clerk Vickie Best

 

Meeting Called to Order

Chairman Ring called the meeting to order at 5:03 p.m. in the Town Hall Boardroom.

 

Request for a setback Variance: Robert & Jerry Lindler: Stoney Ridge Subdivision

Mr. Lindler desires to construct a carport over the driveway on unit 15 of Stoney Ridge Subdivision.

 

Mr. Byrd presented the board members with the Finding of Facts and recommended the variance be granted.

 

Other units within the subdivision have carports. The request passes the variance test. Haywood County allowed carports to be constructed prior to Maggie Valley annexing the area.

 

The carport will appear similar in nature to the existing structures.

 

Chairman Ring informed the board that Council zoned the area Residential 1 but due to circumstances, it would not make a difference.

 

A building permit will be required.

 

MR. PINTER MADE A MOTION TO APPROVE THE VARIANCE BASED ON THE FINDING OF FACTS AND THE BYLAWS OF THE COMMUNITY.

MR. DUBUKE SECONDED THE MOTION.

MOTION CARRIED.

 

The board briefly discussed the sign stating dogs for sell in the parking lot of the Stompin Ground. The zoning board previously made exceptions but now it appears that a kennel is being operated. Mr. Byrd will investigate.

 

THERE BEING NO FURTHER BUSINESS TO DISCUSS, ON MOTION BY MR. DUBUKE, SECONDED BY MR. WIGHT, THE MEETING ADJOURNED AT 5:30 P.M.
