ORDINANCE 481
AN ORDINANCE
REGARDING THE REMOVAL/DISPOSAL OF TREE LIMBS; CUTTINGS; SHRUBBERY;
LEAVES; AND DISCARDED APPLIANCES
WHEREAS, the Board of Aldermen of the Town of Maggie Valley desires to continually increase services to the citizens;
WHEREAS, during the 2006/2007 budget process funds were allocated to begin providing the service for the removal/disposal of discarded appliances and yard waste.
NOW THEREFORE BE IT HEREBY ORDAINED BY THE TOWN BOARD OF ALDERMEN
OF
Section 1: Tree
limbs; Cuttings; Shrubbery; Leaves:
(a) The Town of Maggie Valley will attempt to collect tree limbs, cuttings, shrubbery and the like from each residence of the Town on an as-needed/as-called basis; however, during leaf season, this service will likely be curtailed to allow the collection of leaves. This service shall be limited to the amount of tree limbs, cuttings, shrubbery and the like that a typical resident shall produce in normal yard work and is not a service provided to a landscaping firm or to a private tree trimming/removal company or to individuals who are paid to trim trees, redo landscaping or perform major yard work. Such debris produced by these firms and individuals shall not be collected by the Town, and the property owner or tenant shall be responsible for the cost of removal and disposal of such material. Volumes of more than one truckload or volumes which will take more than thirty (30) minutes to load will not be collected without a charge to the customer. Excess volumes or time shall be billed at the rates prescribed and changed from time to time by the Board of Aldermen and kept on file at the Town Clerk’s office. In any case, such limbs, cuttings, shrubbery and the like shall not be greater than twelve (12) feet in length, nor more than four (4) inches in diameter, nor of such a weight that it can not be handled by one person. This debris is to be placed along the edge of the owner’s or tenant’s property nearest the street right-of-way, with cut ends facing the street, and shall not block any sidewalk or be in the street where vehicles might be prohibited from safe passage. Tree limbs and yard trimmings shall be free of trash, dirt, wire and anything that could damage the chipping equipment. Lawn trimmings and leaves shall be placed in bags for pickup and the weight of a single bag shall not exceed thirty (30) pounds. Machine piled material, logs, stumps or any limbs greater than four (4) inches in diameter shall not be collected. Material addressed in this section shall not be placed in the street or in gutters or drainage ways so as to inhibit storm drainage or so that the material might wash into or block catch basins.
(b) The Town shall at no time remove or assist in the removal of stumps or trees of any
kind.
(c) In situations where there is danger for Town employees or concern for the safety of
the motoring public, the Director of Public Works, at his discretion, may authorize the
collection of any permitted material from a point off the street right-of-way and out of the path of vehicular traffic.
Section 2: Discarded Appliances and Similar Objects:
It shall be the duty of the property owner who wishes to dispose of discarded appliances such as water heaters, stoves, electronic appliances to call the Town Hall and request a special pickup. This is a service provided to residential customers in the normal replacement of home appliances, and shall not be provided to any commercial establishments.
Alderman Price asked that staff talk with a man in Waynesville that takes old appliances and repairs them for resale. If not, staff will store ten to twelve appliances before taking them to the landfill.
ALDERMAN PRICE MADE A MOTION TO APPROVE ORDINANCE 481 AS PRESENTED.

Consideration of a
Resolution Allowing the ABC Board to set up a Capital Improvements Reserve Fund
The ABC Board requested the Town to authorize the ABC Board to set up a capital reserve fund to use for future land acquisition and/or building expansion/improvements.
The maximum amount the ABC Board is allowed to retain is $450,000. If the retained earnings are turned over to the Town; State Law requires 10% to go toward education, 10% to go toward law enforcement and 80% would go to the General Fund.
Alderman DeMeola felt the ABC Board has been good stewards of money thus far. Having the money would provide better leverage to make a better deal when purchasing land.
ALDERMAN ALDRIDGE MADE A MOTION TO APPROVE RESOLUTION
#06-62 ALLOWING THE ABC BOARD TO RESERVE MONEY FOR CAPITAL
IMPROVEMENTS.
MOTION CARRIED UNANIMOUSLY.
The resolution may be rescinded at any time.
Manager’s Report
Manager Barth provided the following information to Council.
►The stage groundbreaking will be held
► A Board of Aldermen Workshop will be held
► Documentation was provided to each Councilmember regarding the unsafe practice of police officers carrying cell phones for the public to use to contact on duty officers.
► NCDOT will be conducting a traffic study in the near
future for
► Manager Barth explained a situation that has developed in the Sherwood Forest Community. A property owner desires sewer in order to build condominiums. The adjacent property owners and the Home Owners Association state that condominiums are not allowed within the development. A three-unit apartment building was in place when the property was purchased. The Town would certainly provide sewer with the property owner paying for and installing almost 2000 feet of sewer line to meet the Town’s lines. The Town is not in a position to move forward until the legalities are clearly defined.
►Manager Barth has researched the procedures for naming roads and bridges. The language is very strait forward when, or if, Council decides to take action.
Other Business
The Zoning Board of Adjustment is in need of an Extra Territorial Jurisdiction member.
Ms. Catherine Young applied and met with the Zoning Board members. The Zoning Board members recommend her appointment.
ALDERMAN DEMEOLA MADE A MOTION TO ASK THE
MOTION CARRIED UNANIMOUSLY.
Manager Barth will attempt to get the appointment on the
upcoming Commissioners’ meeting agenda.
Alderman Edwards questioned the amount of sewer capacity
Manager Barth explained that the treatment plant needs to be
upgraded because of the continued growth taking place in and around
