1.    Meeting Called to Order.

Mayor McElroy called the meeting to order at 6:33 p.m. in the Town Hall Boardroom.

 

2.    Consent Agenda

a.  Certificate of Sufficiency:  James Bennet, Katua Falls

Subdivision, Parcel #’s 7696-88-8076, 7696-98-0093,

7696-98-4237, (14.5 acres): Resolution No. 07-17, Setting a

date for a Public Hearing on May 1, 2007 at 6:30 p.m.

b.  Petition for Annexation:  Maggie Valley Resort, LLC,

208 Alexander Drive, Parcel #7697-70-0156,

(7.424 acres): Resolution No. 07-18,

Directing Clerk to investigate an annexation petition.

c.  Petition for Annexation:  Gulf Highway Land Corp. sold to

Thomas Benoit, #30 Campbell Woods Subdivision,

Parcel # 8606-17-2276,  (0.75 acres): Resolution No. 07-19,

Directing Clerk to investigate an annexation petition.

d.  Correction and Approval of Minutes for April 3, 2007.

 

            ALDERMAN EDWARDS MADE A MOTION TO ADD PETER SMITH WITH STUDIO M TO THE AGENDA.

MOTION CARRIED UNANIMOUSLY.

 

ALDERMAN ALDRIDGE MADE A MOTION TO ADD PAT OWEN WITH HAYWOOD COUNTY SCHOOL FOUNDATION TO THE AGENDA

MOTION CARRIED UNANIMOUSLY. 

 

Mr. Steve Brown addressed the Board explaining their mission.  Haywood County School Foundation is working to recruit and retain highly qualified teachers and staff.  The Foundation is partnering with Blue Ridge Paper Products to bring recording artist Britney Christian, National Spokesperson for the Milk Rocks Campaign, to the Haywood County Schools, to raise money for recruiting and retaining highly qualified teachers, staff development and support of the chorus & band programs. The Master of Ceremony will be Rupert from Survivor on CBS Television.

 

ALDERMAN ALDRIDGE MADE A MOTION TO MAKE A $500 DONATION.

MOTION CARRIED UNANIMOUSLY.

 

ALDERMAN ALDRIDGE MADE A MOTION TO ACCEPT THE CONSENT AGENDA AS PRESENTED.

MOTION CARRIED UNANIMOUSLY.

 

3.    a.  Public Hearing on Annexation of Will Carver, Timberline Drive/Maggie Valley Leisure Estates, Parcel #7686-74-0848 (1.053 acres).

       b.  Consideration of Ordinance No. 535 to annex Timberline Drive/Maggie Valley Leisure Estates, Parcel #7686-74-0848.

Mayor McElroy opened the public hearing at 6:47 p.m. There being no comments from the floor, the hearings closed at 6:48 p.m.

 

ALDERMAN DEMEOLA MADE A MOTION TO ANNEX THE PROPERTY THROUGH ORDINANCE 535.

MOTION CARRIE UNANIMOUSLY.

 

4.    a.  Public Hearing on Annexation of Dan Myers, 3579 Dellwood Road,

            Parcel #8606-29-3067 (0.61 acres).

       b.  Consideration of Ordinance No. 536 to annex 3579 Dellwood Road.

Mayor McElroy opened the public hearing at 6:49 p.m.  There were no comments from the public.  The hearing was closed at 6:50 p.m.

 

ALDERMAN PRICE MADE A MOTION TO ADOPT ORDINANCE 536 ANNEXING THE PARCEL.

MOTION CARRIED UNANIMOUSLY.

 

5.    Appearance of Linda Hamilton to speak about being a substance abuse Prevention Community.

Ms. Hamilton provided information on the ARP/ Phoenix Prevention, a Division of Sisters of Mercy Services.  The prevention system consists of six prevention strategies:

Information Dissemination, Prevention Education, Alternatives, Problem Identification & Referral, Community-based Processes, and Environmental Approaches.

 

Council thanked Ms. Hamilton for the informative presentation and will review the material provided. 

 

6.    Appearance of Sonja Michels regarding a directional sign for Creek Wood Village.

At the previous meeting, Ms. Michels requested that her sign be located in such a manner as to better direct traffic to her rental cabins.  Council tabled the issue until each member could go by the site and look at the sign.

 

Council felt that the sign was visible enough, especially since the silo has been removed.     

 

7.    Consideration of adopting a policy to table items brought forth at meetings that are not on the agenda.

 

Alderman Aldridge had brought this issue up at the previous meeting.

 

ALDERMAN ALDRIDGE MADE A MOTION TO TABLE THE ISSUE UNTIL FURTHER NOTICE.

MOTION CARRIED UNANIMOUSLY.

 

Peter Smith of Studio M Productions

Alderman Edwards asked that Mr. Smith address Council regarding the human flag.  Mr. Smith previously addressed the Parks, Recreation, Festival Advisory Committee about getting into the Guinness Book of Records for making the largest human flag.  The 20,000 plus participants will wear colored ponchos to make the American Flag.

 

Mr. Smith met with the County Commissioners and several other agencies throughout the County.  Everyone is excited by the prospect, although Maggie Valley will need assistance with police, fire, advertising, and parking. Even with assistance from the County and surrounding municipalities, Chief Sutton had concerns about attempting an event this large on July 4th.

 

Mr. Smith would like to have a commitment from the Town that the Festival Grounds can be used and documentation on how many people can be on the Festival Grounds at one time.

 

Mr. Smith will provide the town with more documentation and decide on a more suitable time than July 4th.   

 

8.    Manager’s Report.

Vickie Best, the Town Clerk has completed the County and Municipal Administration Course at the Institute of Government.  A press release will go out tomorrow.  

 

The Town of Waynesville approved the Annexation Boundary Agreement. The Waynesville Council would like to go before the County Commissioners to get a resolution that will be County-wide for annexation boundaries with a three-mile radius.

 

The Brannon Forest Lawsuit against the Town was heard on April 16.  Judge Bryant will make a determination within thirty-days based on the law.  This will not go to trial because the decision will be made on how the law applies to Local Governments.

 

The Rural Center is asking for support for the Clean Water Act of 2007 that provides for a $500 million bond issue to be expended over the next five years, and an annual appropriation of $50 million in recurring funding to address urgent needs. Manager Barth will present a resolution at the next meeting.

 

Town Hall Day is May 9th.  Council has the opportunity to join the local legislators for dinner on May 8th.

 

Staff has completed the proposed areas for annexation .These areas are areas that are already connected to the municipal sewer.

 

Council recessed from 7:43 p.m. until 7:48 p.m.

 

9.    Other Business.

Alderman Aldridge asked Manager Barth to put paying the chamber on the agenda.

 

Alderman Edwards asked that Council and staff consider having one meeting a month at 3:30 p.m. rather than two meetings per month.

 

Manager Barth explained that the annexation process would take approximately 12 weeks.  Council needs to consider the advantages and disadvantages of having the extended waiting period for volunteer annexation.

 

Alderman Aldridge stated that he had received e-mail from some women that perform gospel music for free.  Alderman Aldridge felt they could maybe perform on National Prayer Day.  Alderman Aldridge will talk with Reverend Bond.
