Called to Order
Alderman McElroy called the meeting to order at 1:05 p.m. on March 24, 2005 in the Town Hall Boardroom.

MADE A MOTION TO ACCEPT THE TWO ISSUES PROPOSED FOR THE SPECIAL CALLED MEETING
AND TO ACCEPT ANY COMMENTS FROM THE MANAGER.

SECONDED THE MOTION.
MOTION CARRIED.
Mr. Otis Sizemore challenged the procedures of the special called meeting from the floor.
Resolve Issues Concerning the Festival Grounds
The proposed agreement with Ms. Sonja Michels, adjacent
property owner to the Festival Grounds: We recognize that the former Parks, Recreation and
Festival Committee and/or Town Council said that they would cover the cost of
screening the front portion of your business and move the chain link fence off
the road right-of-way.
It is the consensus of Council and Staff that security is
an issue at the festival grounds and a 6-foot fence is needed around the entire
area.
In an attempt to resolve these issues, the Town is making
the following offer:

The shrubs will be planted on Creek Wood Village’s side
of the fence and you will be responsible for maintenance and/or replacement.

Discuss Issues Concerning Previous Appointments to the
Zoning Board of Adjustments
Attorney Dickson explained that the motion made on March 16, 2005 to rescind the appointments made to the Zoning Board of Adjustment was not permissible due to the meeting being advertised as a budget workshop. The clerk has not notified the appointees of the appointments.

MADE A MOTION TO RESCIND THE MOTION TO APPOINT MS. DENNIS AND MR. ANDERSON MADE
ON MARCH 15, 2005 TO THE ZONING BOARD OF ADJUSTMENTS DUE TO ERRONEOUS MATERIALS
AND THE APPLICANTS OPTING NOT TO INTERVIEW.

SECONDED THE MOTION.

Manager’s Report
The local bill Maggie Valley has requested goes before the House of Representatives on March 29, 2005 at 8:30 a.m. It is suggested that a couple of town representatives be available to answer any questions that may arise.
Due to such short notice and the need for someone familiar with Brannon Forest issues since the inception Public Works Director Mike Mehaffey, Aldermen Mark DeMeola and Manager Shepherd will go to Raleigh.
