MINUTES

Meeting Called to Order

Mayor McElroy called the meeting to order at 6:35 p.m. in the Town Hall Boardroom.

 

 

Consent Agenda

a.  Investment Report for Quarter Ending December 31, 2006.

b.  2006-07 Schedule of Ad Valorem Taxes Receivable.

c.  Budget vs. Actual Revenues and Expenditures Year to Date

Ending January 31, 2007

d.  Tax Release.

e.  Correction and Approval of Minutes for February 6, 2007

meeting and for January 17, 2007 joint meeting with Planning

Board.

 

ALDERMAN DEMEOLA MADE A MOTION TO APPROVE THE CONSENT AGENDA AS PRESENTED.

MOTION CARRIED UNANIMOUSLY.

 

 

3.    a.  Public Hearing on Annexation of Paul & Claudia Blystone, 99 Cripple Creek Drive, Parcel #7697-75-9142 (0.667 acres).

       b.  Consideration of Ordinance No. 519 to annex 99 Cripple Creek Drive.

Mayor McElroy opened the public hearing at 6:38 p.m.  There were no comments from the floor.  Mayor McElroy closed the hearing at 6:38 p.m.

 

ALDERMAN DEMEOLA MADE A MOTION TO ANNEX THE BLYSTONE PROPERTY UNDER ORDINANCE 519.

MOTION CARRIED UNANIMOUSLY.

 

 

4.    a.  Public Hearing on Annexation of Joe & Martha Trapp, 257 Springlake            Road, Parcel #7686-64-1583 (0.593 acres).

       b.  Consideration of Ordinance No. 520 to annex 257 Springlake Road.

Mayor McElroy opened the public hearing at 6:40 p.m. There were no comments from the floor.  Mayor McElroy closed the hearing at 6:40 p.m.

 

ALDERMAN ALDRIDGE MADE A MOTION TO ANNEX THE PROPERTY AS REQUESTED THROUGH ORDINANCE 520

MOTION CARRIED UNANIMOUSLY.

 

5.    Consideration of an ordinance to allow the Town Manager to declare surplus and   sell, any items valued at less than $5,000.00.

It is common in Council – Manager form of government to allow managers to declare surplus items up to a limited amount without Council approval.  This is generally recognized as a way to streamline the process.  Council will be notified of all items being deemed surplus no later than the next regularly scheduled Council meeting.

 

ALDERMAN EDWARDS MADE A MOTION TO ALLOW MANAGER BARTH TO SURPLUS ITEMS UP TO $5,000.

MOTION CARRIED UNANIMOUSLY.

 

 

6.    Report to the governing board a list of all taxpayers owing taxes for current fiscal year, which are liens on real property.

Council was presented a list of delinquent tax payers to be advertised in March 2007 as stated under the General Statutes. The past due taxes are liens on real property.

 

The list will be adjusted for any taxes received until publication.

 

ALDERMAN DEMEOLA MADE A MOTION TO APPROVE THE ADVERTISING OF DELINQUENT TAX PAYMENTS AND PROCEED AS NECESSARY FOR COLLECTION.

MOTION CARRIED UNANIMOUSLY.

 

 

7.    Manager’s Report.

A Calendar of Events prepared by the Maggie Valley Chamber/Visitors Bureau was distributed to Council.

 

There were no upset bids on the structure currently located on the Parham Park.  The SARGE organization will be awarded the building at a cost of $2,210.

 

The Land Use Plan will be presented to the Board of Directors for the Maggie Valley Chamber/ Visitors Bureau on February 22 at noon at Smoky Falls Lodge. Council members are invited to attend to hear comments about the proposed plan.

 

Manager Barth and Planning Director Clark met with Kim Davis to discuss the landscaping requirements for parking lots.  Ghost Town associates would like to get a variance to allow them three years to come into compliance due to the amount of work needed to the parking lot. The landscaping will be phased in as the parking lot is refurbished.  

 

8.    Other Business.

The vacant ABC Board member position has been advertised and posted for several weeks now.  The closing date to submit an application was February 19, 2007. Mr. Ralph Wallace submitted the only application for the position.

 

ALDERMAN EDWARDS MADE A MOTION TO APPOINT RALPH WALLACE TO THE POSITION ON THE ABC BOARD.

MOTION CARRIED UNANIMOUSLY.

 

 

Due to the event not being feasible, the Maggie Valley Chamber of Commerce/ Visitor’s Bureau did not include the annual Trout Festival in their 2007 calendar of events.  It takes many volunteers and some funding for the operating budget. Due to the exhibitors being volunteers, it had been suggested that the event be shorten to a one-day event rather than two.  

 

Ms. Collins is willing to spearhead the festival, if the Town will provide volunteers and funding.  The Town will carry the expense and receive any revenues made. 

 

Mayor McElroy spoke with Senator Joe Sam Queen, (whom was instrumental in starting the Trout Festival) and was told Senator Queen would support the Festival any way he could.

 

Council volunteered their support.

 

ALDERMAN ALDRIDGE MADE A MOTION TO SPONSOR THE 2007 TROUT FESTIVAL AND TO AUTHORIZE MANAGER BARTH TO RELEASE FUNDING AS NEEDED FOR THE EVENT.

MOTION CARRIED UNANIMOUSLY.

 

 

9.    Public Comment.

Mr. Dan Massey addressed Council asking to use the pavilion kitchen. Granny’s Kitchen would use it to keep food warm during a concert he plans to have during the summer from approximately 6:30 p.m. until 8:30 p.m. every Friday May through July.  There will not be an admission charge although donations will be accepted for the band members.

 

Mr. Massey had been told that the pavilion kitchen belonged to the Civic Association, but then Town staff informed him that the Town owns the kitchen.

 

The Civic Association purchased the equipment so Council felt that it should be a congenial situation therefore Mr. Massey would need approval from the Association. If approved by the Civic Association, Council will approve.
